A Bryan man has been sentenced to 25 years in state prison after pleading guilty to felony Driving While Intoxicated (DWI) 3rd or More.
On March 10, 2026, around 1:55 p.m., David Vance Pennington called 911 while driving. He told the emergency operator that he was driving drunk and would not stop until a police officer pulled him over. Pennington explained that he was driving from Temple to College Station, began “seeing double,” and called for help because he did not want to hurt anyone on the road.
A College Station police officer spotted Pennington’s car driving south on Texas Avenue. When the officer turned on their emergency lights, Pennington did not stop right away. He turned onto Valley View Drive before pulling into the parking lot of the BCS Asian Market.
When officers approached Pennington, he was slurring his speech and could barely stand. Officers had to hold him up to keep him from falling to the ground. Pennington admitted to drinking nine 16-ounce Bud Light beers during his trip from Temple. Inside the vehicle, police found nine empty beer cans and a case of beer on the passenger seat. Pennington rated his level of intoxication an 8 out of 10. A breath test later showed his blood alcohol concentration was 0.125.
“Our top priority is making sure families can travel safely on the roads of Brazos County. We are grateful for the quick work of the College Station Police Department in stopping this dangerous driver, and this 25-year sentence ensures our community remains protected from repeat offenders.”
— Assistant District Attorney Kevin Capps
Pennington has a criminal history dating back to 1990. His past offenses include burglary of a vehicle, impersonating a peace officer, theft, assault, unauthorized use of a motor vehicle, drug possession, and robbery.
This case marks his fourth DWI conviction. He was previously convicted of felony DWI in 2016. He was out on parole for that crime when this incident occurred.
We thank the College Station Police Department for their quick response and work to keep our roadways safe.
