Submitting a claim does not guarantee reimbursement or payment. All claims are reviewed to determine whether the County may have legal responsibility under applicable law.

County Liability
Brazos County is a governmental entity and may be entitled to governmental immunity under state law. In many situations, the County is not responsible for damage unless the evidence shows that the County or a County employee was negligent and the law allows the claim to be paid.
The County is generally not liable for damage resulting from conditions or events outside of its control, including, but not limited to:
- Rocks, gravel, debris, or other objects propelled from the roadway by normal traffic
- Common roadway hazards
- Damage caused by other drivers or third parties
- Weather-related events
- Falling trees, limbs, or other natural conditions unless caused by County negligence
- Damage occurring on private property or roads not maintained by the County
- Pre-existing vehicle or property damage
- Incidents where no County employee, County vehicle, County equipment, or County-maintained property contributed to the damage
Roadway hazards such as loose rocks, debris, or objects kicked up by traffic are generally considered ordinary roadway conditions. The mere fact that an incident occurred on or near a County-maintained road does not, by itself, establish County liability.
Claims should include sufficient documentation to demonstrate how the County or its employees caused or contributed to the damage. If the review does not establish negligence or legal responsibility, the claim may be denied.
